Ebay Seller sent me a torn/used item?

I have a bit of a problem- I purchased a handbag from an ebay seller who lives in India. Their 14 day return policy states that they will accept returns with 100% money back guarantee. Then below that in small writing it says that each case will be treated differently and in the event that a refund is required they charge a +25% restocking fee. So I was supposed to be sent a new brightly colored purse, I received a purse that is dirty, it looks like it was dragged through dirt, missing some rhinestones on it, there is dried glue stuck to it, and the most annoying part- the fabric is ripped in some places and glued a few centimeters away from where it should be leaving the lining of the purse exposed. All in all, its bad craftsmanship. So I told the seller I would like a return. The only emails that I am getting back say "please try it one more time, Im sure you will like it" then I say I dont like it and sent over pictures of the purse, and again the only response Im getting is "please give it a try, Im sure you will receive many compliments on it" after stating over and over again no, I do not want it, I want a refund. I opened up a case with Ebay and ebay says that the seller needs to respond within 4 days. Now the problem is, is that they are responding to my emails, but they are just saying to give it a try. So what will Ebay do if they do not offer me a refund? And it seems to me that they are waiting until the 14 day return policy expires. I received the purse a week ago and have been emailing back and forth but does the purse need to be returned within the next week to comply with the 14 day return policy? If so the shipping charges will cost more than the purse.

Your experience is a perfect example of why I will never use eBay or PayPal. You get zero protection against unscrupulous sellers. Stop buying things from overseas sellers and look to local brick and mortar retailers or thrift shops in your community.

Hi, you reply back that the listing was for a new purse and the item you received was used and damaged and on that basis you want a full refund. Through ebay you can escalate the dispute to a claim at which time eBay will look at both "sides of the story" and either you will win and be told to return the item and get a refund or the seller will win and you are stuck with it. Only buy from reputable sellers, those with high sale numbers and good, happy buyers leaving positive feedback. Otherwise you risk getting rubbish goods.

First off, give him unhealthy feedback. Then contact him once more; if he doesn't reply file a complaint order through ebay and try to get the proper DVD or your a reimbursement. I'm a seller on ebay and i've also been via your situation. As a vendor you dont even get the payment from the purchaser except they give the seller correct suggestions and make certain that the object used to be shipped correctly. Paypal has a maintain on the money except they are sure the transaction is legitimate. For your case, the seller wont even get your cash unless you give confident suggestions (im assuming yur not gonna do that) or the 21 day hold that paypal has wares off. Except then contact ebay and file a criticism. Just right success
